Terms version 2026-10-19.1
Membership terms & watersports indemnity
The Participant is the person named in this application. If the Participant is under 18, a parent or legal guardian must complete the consent and sign. In these terms, ‘I’ means the adult Participant or that parent or guardian, as applicable. ‘Activities’ means all watersports provided or organised by SeaQuest Academy, including sailing, dinghy sailing, kayaking, stand-up paddleboarding, boating, training, charters and associated shore, launch, recovery and on-water activities. This consent does not replace any activity-specific briefing, suitability assessment or additional agreement.
Membership declaration
I confirm that my information is true and accurate. Individual membership has a standard annual fee of RM500. Staff will confirm the amount payable and any agreed pro-rata adjustment separately; this form does not collect payment or prove payment. Membership starts on registration and runs through 31 December of that calendar year, expiring on 1 January. Renewal extends membership by one calendar year. I agree to follow Academy rules, safety requirements and operating procedures. Membership offers access to the community and selected facilities and preferential rates where available. Storage, equipment rental, training, charters, food and beverages, and events may carry separate charges. Facilities, benefits and activities depend on availability, operating conditions and applicable terms; material changes will be communicated. The membership fee is non-refundable after activation except where required by law or agreed by the Academy in writing. Serious breaches of rules, safety requirements or conduct standards may lead to suspension or termination, subject to applicable law.
1. Assumption of risk
I understand that the Activities involve inherent risks, including drowning, injury or death, collision, capsizing, falls, equipment failure, changing weather, tides and currents, marine life, damage to property, and exposure to sun, wind and water. I voluntarily accept the inherent risks of participation. The Academy is expected to take reasonable precautions and exercise the care required by law; this acknowledgement does not remove those duties. I will follow safety instructions, use required protective equipment and stop or seek assistance when conditions or ability make participation unsafe.
2. Medical disclosure and suitability
To the best of my knowledge, the Participant can take part safely subject to the medical conditions, allergies, medication, access needs and swimming ability disclosed in this form. I will tell the Academy about relevant changes before participating and seek medical advice if unsure about suitability. The Academy may require further information, adapt an activity or decline participation where needed for safety. Membership is not medical clearance or a guarantee of eligibility for every activity.
3. Release and indemnity
To the extent permitted by Malaysian law, I accept responsibility for loss or damage resulting from my or the Participant’s deliberate misconduct or failure to follow reasonable safety instructions. I agree to indemnify the Academy and its directors, officers, employees and agents for reasonable, proven third-party claims directly caused by that conduct, only to the extent of that responsibility. This does not require me to indemnify anyone for their own negligence, wilful misconduct or breach of a duty that cannot lawfully be excluded.
4. Liability and rights
To the extent lawfully permitted, I release claims arising solely from the inherent risks I have voluntarily accepted. Nothing in this agreement excludes or limits liability for negligence, fraud, wilful misconduct or any liability or consumer right that cannot lawfully be excluded or limited. A parent or guardian’s signature does not purport to remove any right of a child that the law does not permit them to waive.
5. Insurance
Any insurance available through the Academy is subject to the actual policy terms, limits and exclusions. I will not assume that participation includes personal accident, medical, travel or equipment cover, or that every risk is insured. I may ask the Academy about current cover and arrange suitable personal insurance.
6. Emergency medical treatment
If an emergency occurs, I authorise the Academy to arrange first aid, emergency assistance, transport and assessment or treatment by qualified medical professionals for the Participant where necessary. Staff should try to contact the named emergency contact or guardian when practicable. Clinical decisions and consent requirements remain with the treating professionals and applicable law. Relevant health and contact information may be shared with emergency responders for this purpose.
7. Participant and parental responsibility
I will ensure that I or the Participant follow Academy rules, staff instructions, safety briefings and equipment requirements. For a Participant under 18, I confirm that I am their parent or legal guardian and have authority to give this consent. I will provide accurate emergency contact details, remain contactable during Activities and make the supervision and collection arrangements required by the Academy.
8. Cancellation and refunds
The Academy may postpone, modify or cancel an Activity because of unsafe weather or water conditions, equipment issues, insufficient enrolment or other circumstances affecting safe delivery. Any refund, rescheduling or credit will follow the terms disclosed for that booking and applicable consumer law. This membership form does not override a statutory entitlement to a refund or other remedy.
9. Governing law and disputes
This agreement is governed by the laws of Malaysia as applicable in Johor. The parties should first try to resolve concerns directly with the Academy. Any later agreement to mediation or arbitration must be made separately in writing where lawful. This clause does not prevent access to a court, tribunal, regulator or other remedy available under applicable law.
10. Entire agreement and electronic signature
These terms, this completed application and any separately accepted activity-specific booking terms record the agreement for their respective subjects. They do not override mandatory law or lawful rights arising from representations that cannot be excluded. I have had the opportunity to read these terms and ask questions. By typing my name, choosing a signature method and checking the consent boxes, I intend to sign electronically and confirm my agreement. A copy of the submitted application and the version of these terms accepted will be retained by the Academy.
